Advertising Terms of Service

1.  The Kevin Smith Show reserves the right to reject any advertiser or advertisement for placement on the Kevin Smith Show web site, or inclusion in spot rotations on the show, or associated with the Kevin Smith Show in any way whatsoever.  The decision will be based on what the Kevin Smith Show deems to be in its best interest and shall be made at the discretion of the Kevin Smith Show.   †See Guidelines below.

2. Button and Banner ads require graphics which must be provided by the advertiser.

3. Radio Spot ads may be provided by the advertiser along with a certification that the ad is cleared for royalty free use.  However, if the advertiser does not have a radio spot already produced and cleared for royalty free use, the Kevin Smtih Show will produce one.  Any such ad produced by the Kevin Smith Show is cleared for use only on the Kevin Smith Show unless otherwise stated in writing by Kevin W. Smith.

4. The Kevin Smith Show will not be held responsible for technological failures such as power outages, server failures, etc.  Should a technological failure occur, the full number of ad insertions will be honored beginning with the first moment the technology has returned to working condition. 

5. Calculation of rates for CPM based ads (i.e. Banners on the Player Page) is accomplished in this manner:

At the end of each show, the streaming servers produce a report of our exact audience numbers throughout the show, and an average.  The average is used to calculate the CPM based on achieved benchmarks.  An achieved benchmark means we do not round-up to the next cpm.  If we have not achieved it, we do not charge for it.   If the audience numbers average lower than your bid, you will be charged only for the actual average.

In order to make budgeting simpler for our advertisers, we currently cap the cpm for .25/cpm additional.

A $2/CPM rate can be capped at $2.25/CPM.  So, if you cap your CPM at $2.25 and you bid 50 CPM, we would charge you $2.25 * 50 even if our audience numbers exceeded your bid.  So, if our audience numbers went to and average of 75,000 you would be charged based on the 50,000 that you bid.  If you choose not to cap the CPM, you would be charged the lower $2 per CPM, but would pay for the entire 75,000 listeners.

Here is the difference in dollars if the audience surges to 75,000 listeners.

CAPPED CPM:   $2.25 x 50 x (5 days) = $562.50

NONCAPPED:    $2 x 75 x (5 days) = $750

Minimum CPM Bid: 50

6. Advertisers will be provided access to ad response tracking for button and banner ads. 

7.  Ads must be paid for in advance.

†Guidelines:  The following types of ads would be rejected.

ADULT CONTENT ADS
ANTI-AMERICAN ADS
ADS PROMOTING HATE and/or VIOLENCE
ADS PROMOTING ILLEGAL ACTIVITY
ADS FROM GROUPS KNOWN TO BE LINKED TO TERROR ORGANIZATIONS
ADS THAT ARE SLANDEROUS IN NATURE
